1. Introduction

Welcome to CareerPCS.com, operated by Career PCS, LLC (dba CareerPCS.com). By accessing or using our website and services, you agree to comply with and be bound by these Terms of Service ("Terms"). These Terms govern your access to and use of the CareerPCS.com platform and services.

1.1 Definitions:

  • Career PCS, LLC: Refers to the company operating CareerPCS.com, providing services to connect transitioning servicemembers and DoD SkillBridge Authorized Organizations.
  • Servicemembers: Refers to active duty U.S. military personnel who are eligible for the DoD SkillBridge program and are using the Career PCS platform to find and apply for internship and training opportunities as they transition to civilian careers.
  • DoD SkillBridge Authorized Organizations: Refers to companies that the Department of Defense has approved to offer internship and training programs to transitioning servicemembers through the DoD SkillBridge program. These companies use the Career PCS platform to post and manage their opportunities.

Collectively, “users” refers to all servicemembers and DoD SkillBridge Authorized Organizations who access and use our platform and services.

3. Service Description

CareerPCS.com aims to be the premier destination for finding and listing SkillBridge opportunities. Our platform offers a variety of features designed to address current marketplace inefficiencies and provide a user-friendly interface for posting and applying to listings. Our services include:

  • Search Functionality: Users can filter job opportunities by duration, attendance type (in-person, hybrid, remote), and category (e.g., Administration, Aerospace & Defense, IT).
  • Job Listings: Detailed job listings with information on the position, company, location, and job type (full-time, part-time).
  • Profile Creation: DoD SkillBridge Authorized Organizations can create profiles to list their SkillBridge opportunities.
  • Verification System: Our optional military status verification is a crucial feature that enhances the credibility of applicants. Users can gain a competitive edge in the application process by entering their military emails to verify their military status.
  • Employer Tools: Tools for DoD SkillBridge Authorized Organizations to post and manage job listings.

4. User Accounts

4.1 Account Creation

DoD SkillBridge Authorized Organizations can easily create accounts to access our services. During the account creation process, the employee creating the account must find and select their company. This is made possible through CareerPCS.com via the DoD SkillBridge website API, where users can select from a drop-down menu of DoD Skillbridge Authorized Organizations. The employee must also upload their company’s approved DoD SkillBridge Memorandum of Understanding (MOU), which authorizes the company's SkillBridge-approved partnership. The following information is required during account creation:

  • Company Information
    • Legal Business Name
    • Contact Name
    • Contact Email
  • Email Verification
  • Uploaded DoD SkillBridge Memorandum of Understanding (MOU)
  • Agreement to the Terms of Service and Privacy Policy

4.2 Servicemember Eligibility

Only United States Military Service Members eligible to participate in the DoD SkillBridge program may use the platform to apply for opportunities. Civilians and non-active duty military members are prohibited from applying to SkillBridge opportunities through CareerPCS.com.

4.3 User Responsibilities

Users are responsible for providing and maintaining accurate and up-to-date information during registration and use of the platform. Users must refrain from engaging in activities that violate applicable laws or regulations, infringe on the rights of others, or disrupt the platform's functionality.

5. Payment and Subscription

5.1 Subscription Services

DoD SkillBridge Authorized Organizations can subscribe to our services on a monthly or yearly basis. Companies can also pay a one-time fee to "Feature" an opportunity, which pins the listing atop search results for specific categories. A company can feature an opportunity and choose which category to associate the listing with.

5.2 Payment Policies

Payments are made monthly and are non-refundable. Companies can cancel their subscriptions anytime, and all payments are considered final.

6. Content and Intellectual Property

6.1 Ownership of Content

DoD SkillBridge Authorized Organizations own the content they post on the platform. However, CareerPCS.com retains a limited license to use, reproduce, and display this content for digital marketing purposes.

6.2 User-Generated Content

When you submit or post content on Career PCS, you grant Career PCS, LLC (dba CareerPCS.com) a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform, and display such content and to incorporate it into other works in any form, media, or technology now known or later developed.

6.2.1 Responsibilities and Restrictions:
  • Ownership and Rights: You represent and warrant that you own or have the necessary rights and permissions to use and authorize Career PCS, LLC, to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any content you submit or post.
  • Content Accuracy: You are solely responsible for the content you post. All content must be accurate, truthful, and not misleading.
  • Prohibited Content: You agree not to submit or post content that is illegal, defamatory, obscene, offensive, or infringes on any intellectual property rights. This includes but is not limited to content that:some text
    • Violates local, state, national, or international laws.
    • Contains viruses, malware, or any other harmful code.
    • Promotes discrimination, hate speech, or violence.
    • Contains unauthorized commercial communications (such as spam).
6.2.2 Monitoring and Removal:
  • Content Monitoring: We do not routinely monitor user-generated content, but we reserve the right to do so. We may review, edit, or remove any content at our discretion, especially if it violates these Terms.

6.2.3 Content Use by Career PCS, LLC:
  • Marketing and Promotion: We may use user-generated content for marketing and promotional purposes. By submitting content, you agree to its use in promotional materials.
  • Feedback and Improvements: Any feedback, comments, or suggestions provided by users will be treated as non-confidential and non-proprietary. We reserve the right to use such feedback to improve our services without any obligation to compensate you.

7. Privacy and Data Collection

7.1 Data Collection

We collect various types of data to facilitate the features and functionality of our platform. The data collected includes:

  • Personal Information: This includes your name and email address. For military status verification, we collect and verify .mil email addresses.
  • Job Application Data: This includes information related to job applications such as job title, company name, job location (city and state), job type (full-time, part-time), duration of the job (e.g., 1-2 months, 2-3 months), and attendance type (in-person, hybrid, remote).
  • Account Data: For employers, we collect company information, including details provided in the DoD SkillBridge Memorandum of Understanding (MOU), as well as detailed job listing information.
7.1.1 Use of Collected Data:
  • Facilitation of Services: The data collected is used to match servicemembers with relevant job opportunities and to enable employers to post and manage job listings.
  • Verification: We use collected data for two types of verification:
  • Military Email Verification: This ensures that applicants are active servicemembers by verifying their .mil email addresses.
  • Company Verification: This confirms that employers are DoD SkillBridge Authorized Organizations by verifying company details and the DoD SkillBridge Memorandum of Understanding (MOU).
  • Communication: Personal information such as email addresses is used to communicate with users regarding their account, job applications, platform updates, password resets, and promotional material.
  • Improvement of Services: Aggregate data is used to improve platform functionality and user experience and to develop new features.

7.2 Data Protection

We implement stringent security measures to protect user data against unauthorized access, alteration, or destruction. Our data protection practices include:

  • Encryption: Data is encrypted both in transit and at rest. We use advanced encryption protocols to ensure the confidentiality and integrity of user data.
  • Access Controls: Strict access controls and authentication measures are in place to prevent unauthorized access to sensitive information. This includes multi-factor authentication (MFA) for added security.
  • PCI Compliance: We use Stripe, which is PCI-DSS compliant for payment processing. This ensures that all credit card information is handled securely.
  • Regular Audits: We conduct regular security audits and assessments to maintain high security standards.

7.3 Third-Party Services

Our platform integrates with several third-party services to enhance functionality. These services have their own privacy and data protection measures:

  • Algolia: For providing a fast and rich search experience. Algolia implements robust data protection measures, including data encryption in transit and at rest, and complies with GDPR and CCPA to ensure data privacy and security.
  • Canny: Canny is used to collect user feedback and manage feature requests. The data collected by Canny includes personal information such as email addresses and names, as well as usage data such as IP addresses and browser types. This data helps us improve our services by analyzing user feedback and feature requests. 
  • Cloudflare: For domain hosting, email notifications, and network security. Cloudflare provides industry-leading DDoS protection, full data encryption in transit, robust access controls, and compliance with GDPR, CCPA, and ISO certifications.
  • Google Analytics: Google Analytics is used to track and report website traffic, helping us understand user interactions with our platform. Google Analytics collects data such as IP addresses, browser types, and pages visited. This data is used to improve our services and enhance user experience. Google Analytics complies with GDPR and CCPA and offers tools for data anonymization and user data protection.
  • Google Firebase: Used to store all other data. Firebase offers data encryption in transit and at rest, comprehensive access management tools, and compliance with key regulations such as GDPR and CCPA.
  • HotJar: Used to collect user behavior data, such as mouse movements, clicks, scrolling activity, and session recordings, as well as feedback through surveys and polls. This data is used to analyze and improve the user experience, identifying areas for optimization based on how users interact with their site.
  • Stripe: For payment processing and storing payment data/information. Stripe uses advanced encryption protocols, is PCI-DSS compliant, and conducts regular security audits.

7.4 User Consent

By using the platform, you consent to the collection and use of their data as outlined in our Privacy Policy, which will be provided and linked here.

7.5 Third-Party Terms

You must comply with the terms of these third-party services, which are integrated into our platform to provide a seamless user experience.

8. Dispute Resolution

8.1 Process for Handling Disputes

Any disputes between users and Career PCS, LLC will be resolved individually through binding arbitration, not as a class or collective action. The arbitration will be conducted under the American Arbitration Association (AAA) rules in the State of Texas. Users waive their right to participate in class actions. If arbitration is found unenforceable, the dispute will be resolved in the courts of competent jurisdiction in Texas, and the parties agree to submit to the personal jurisdiction of these courts.

9. Limitation of Liability

9.1 Disclaimers

The platform is provided "as-is" and "as available." Your use of the platform and our services is at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the platform and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranties or representations about the accuracy or completeness of the platform's content or the content of any websites linked to the platform. We will assume no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content and materials, (2) personal injury or property damage of any nature whatsoever resulting from your access to and use of the platform, (3) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from the platform, (5) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the platform by any third party, and/or (6) any errors or omissions in any content and materials or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the platform.

9.2 Limitation of Liability

Career PCS, LLC and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, exemplary, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the platform, even if we have been advised of the possibility of such damages. In no event will our total liability to you for any claims arising out of or relating to these terms or your use of the platform exceed the amount paid by you to Career PCS, LLC, during the twelve (12) months prior to the cause of action or one hundred dollars ($100), whichever is greater. Specific state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply, and you may have additional rights.

10. Modifications and Termination

10.1 Changes to Terms

We reserve the right to modify these Terms at any time. When significant changes are made, we will notify users via email and provide a notice on our platform. It is the responsibility of users to review any modifications. Continued platform use after any modifications indicates acceptance of the new Terms. If users do not agree to the modified Terms, they should discontinue use of the platform immediately.

10.2 Termination of Services by Companies

DoD SkillBridge Authorized Organizations can cancel their subscriptions anytime through their Account Settings on the platform or by contacting admin@CareerPCS.com. Upon termination, companies will no longer have access to their accounts, and Career PCS will archive all associated data. Any outstanding payments or fees will remain due and payable.

10.3 Termination of Services by Servicemembers

Servicemembers do not create accounts on the platform but can choose to verify their military status when applying for opportunities. If a servicemember wishes to stop using the platform, they can simply cease further participation by not applying to any listings. If they wish to remove their data, they can contact admin@CareerPCS.com.

10.4 Suspension and Termination by Career PCS

Career PCS reserves the right to suspend or terminate any user account that violates these Terms or engages in prohibited activities. Users will be notified of the suspension or termination via email. Such termination or suspension may occur without prior notice if it is deemed necessary to protect the interests of Career PCS or its users.

10.5 Effects of Termination

For companies, access to the platform will be immediately disabled upon termination of services, and all job listings and associated data will be archived. Termination does not affect any rights or obligations accrued before termination. Any provisions of these Terms intended to survive termination shall remain in effect.

10.6 Reinstatement of Services

If a user’s account has been suspended or terminated and they wish to reinstate their access, they must contact admin@CareerPCS.com. Reinstatement will be at the sole discretion of Career PCS and may be subject to additional terms and conditions.

11. Governing Law

The laws of the State of Texas govern these Terms of Service. Any disputes arising from or relating to these Terms will be resolved in accordance with the laws of the State of Texas.

12. User Communication

Users agree to receive communications from Career PCS regarding their account and services. Users can opt out of marketing communications by following the instructions provided in the emails.

13. Additional Terms for Employers

13.1 Posting Opportunities

Employers must ensure SkillBridge opportunity listings are accurate and comply with DoD SkillBridge guidelines. Career PCS may remove inaccurate or misleading content, which may result in account suspension or termination.

13.2 Compliance

Employers must comply with all applicable laws and regulations when using the platform. Failure to comply may result in account suspension or termination.

14. Additional Terms for Servicemembers

14.1 Eligibility Verification

Servicemembers must verify their eligibility for the DoD SkillBridge program by providing accurate information during the application process. False information may result in disqualification from using the platform.

14.2 Application Process

Servicemembers must provide accurate information when applying for opportunities through the platform. Only complete or correct applications may be accepted by employers.

15. Termination and Suspension of User Accounts

15.1 Termination by Companies

DoD SkillBridge Authorized Organizations may terminate their account anytime by contacting admin@CareerPCS.com or canceling within their Account Settings on the platform. Upon termination, companies will no longer have access to their accounts, and Career PCS will archive associated data.

15.2 Servicemembers

Servicemembers do not create accounts on the platform. If a servicemember wishes to stop using the platform, they can simply cease further participation.

15.3 Suspension and Termination by Career PCS

Career PCS reserves the right to suspend or terminate any user account that violates these Terms or engages in prohibited activities. Users will be notified of the suspension or termination via email.

16. Indemnification

You agree to defend, indemnify, and hold harmless Career PCS, LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of the platform, violation of these Terms, or violation of any rights of another. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding subject to this indemnification upon becoming aware.

17. Changes to the Platform

Career PCS reserves the right to change the platform and its features without prior notice. Users will be informed of significant changes that may affect their platform use.

17.1 Corrections

We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the platform at any time without prior notice.

18. Feedback

We welcome and encourage you to provide feedback, comments, and suggestions for improvements to the platform ("Feedback"). Users acknowledge and agree that all Feedback will be the sole and exclusive property of Career PCS. Users hereby assign to Career PCS all their rights, title, and interest in and to all Feedback.

20. Acceptance of Terms

By using the Career PCS platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. Visiting the platform, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

21. Miscellaneous

21.1 Entire Agreement

These Terms constitute the entire agreement between the users and Career PCS, LLC, regarding the use of CareerPCS.com.

21.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

21.3 Waiver

Failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
